Welcome to Uhize. By accessing or using the Uhize platform at uhize.com and any associated services (collectively, the "Service"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree with any part of the Terms, you must refrain from using the Service. Your continued use of the Service constitutes acceptance of the Terms as they may be updated from time to time. We may modify the Terms at our sole discretion; you are responsible for reviewing them periodically.

2. Changes to Terms

We reserve the right to revise or modify these Terms at any time. Material changes will be communicated through the Service or via the contact information associated with your account. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.

3. Access and Use of the Service

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms. You may not reproduce, distribute, modify, create derivative works, publicly display, or otherwise exploit any content from the Service without our prior written consent. Any rights not expressly granted herein are reserved.

5. Third-Party Links and Google Play Hosting

The Service aggregates and presents listings for applications that are hosted and distributed through Google Play. Uhize does not host the actual application files or content contained on Google Play, and installation/updating of apps occurs on the Google Play platform in accordance with Googleâ€™s terms. Links to Google Play listings or third-party app pages are provided for convenience and do not constitute an endorsement by Uhize. We do not guarantee the availability, security, legality, or quality of any third-party apps accessed via the Service. Your interactions with third-party apps are governed by the terms and policies of those third parties, and Uhize bears no responsibility for such content or conduct.

6. Disclaimers

THE SERVICE IS PROVIDED ON AN â€œAS ISâ€ AND â€œAS AVAILABLEâ€ BASIS. UHIZE AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR RESULTS. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. NO ADVICE OR information OBTAINED BY YOU FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES SHALL UHIZE, ITS AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR BUSINESS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE OR THE CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE TOTAL LIABILITY OF UHIZE AND ITS AFFILIATES AND SERVICE PROVIDERS FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF TEN DOLLARS ($10) OR THE AMOUNT PAID, IF ANY, BY YOU TO USE THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

8. Indemnification

You agree to defend, indemnify, and hold harmless Uhize and its officers, directors, employees, contractors, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneysâ€™ fees) arising from your use of the Service, your violation of these Terms, or infringement of any third-party rights.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Uhize operates, without regard to conflict of laws principles. Any disputes arising out of or relating to these Terms or the Service shall be resolved in the competent courts of the applicable jurisdiction, except as required by applicable consumer protection laws or other rights that may not be waived.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without prior notice. Upon termination, you must discontinue use of the Service and destroy any downloaded materials in your possession. Termination does not affect obligations that accrued prior to termination or any provisions that by their nature should survive termination.

11. General Provisions

These Terms constitute the entire agreement between you and Uhize regarding the Service and supersede all prior or contemporaneous communications and proposals, whether oral or written. If any provision is found invalid or unenforceable, the remaining provisions shall remain in full force and effect. No waiver of any breach or default shall be deemed a further or continuing waiver. We may assign these Terms, in whole or in part, to a successor in interest without notice to you.
